Depends where you are. Here in Australia IPAustralia has enough information available to know if you are or are not infringing, besides the fact that if IPA approved your mark, then it’s 95% kosher. If that’s the case, then just sit tight and do not communicate at any level with them but at the same time make sure you don’t use your mark in a way that they can say ’see, look what he’s doing’.

If you’re right and know you are, then sit tight until the time for them to be fuckwits runs out and they really have to front their case. In my case, when that time came and I turned up to the front line with some decent ammo, they backed off totally.

This almost mirrors my circumstances with Myspace - division of News Corp.

I lodged a trademark application for the word “ourspace” well over 12 months ago which was subsequently accepted. Like clockwork every 3 months from the time it was originally gazetted their attorneys sort extensions of time to lodge evidence for opposition.

I have now received 2 ring binders full of stat decs and supporting exhibits presented as their “evidence”. Like you I also received bullying letters. Thanks for documenting all this as I may use this as a guide to how I deal with things going forward.
